• incidental damages;
• consequential damages;

• punitive damages;
• special damages;
• loss of profits;
• loss of revenue;
• loss of opportunity;
• business interruption;
• goodwill;
• loss of reputation;
• procurement costs;
• data loss;

• merchant disputes;
• purchasing decisions;
• search inaccuracies;
• AI-generated outputs;
• virtual try-on inaccuracies;
• product defects;
• merchant misconduct;
• payment disputes.

IN NO EVENT SHALL DAAMIA'S AGGREGATE LIABILITY EXCEED THE GREATER OF:

• the total amount actually paid by the user to Daamia during the preceding twelve (12) months; or
• USD $100,

unless a greater limitation is prohibited by applicable law.

29Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAAMIA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF:

• merchantability;
• fitness for a particular purpose;
• title;
• non-infringement;
• uninterrupted operation;
• availability;
• security;
• compatibility;
• reliability;
• completeness;
• search accuracy;
• recommendation quality;
• AI accuracy;
• virtual try-on realism;
• merchant performance.

Daamia does not warrant that:

• Services will always remain available;
• defects will always be corrected;
• search results will always be complete;
• products will remain available;
• merchants will honor listings;
• AI-generated recommendations will always be suitable.

Users assume all risks arising from use of the Services.

30Indemnification

You agree to defend, indemnify, and hold harmless Daamia, its affiliates, officers, directors, employees, contractors, licensors, successors, assigns, suppliers, and partners from any claims, damages, liabilities, losses, judgments, settlements, penalties, costs, expenses, or reasonable legal fees arising out of or relating to:

"AI" means artificial intelligence, machine learning, computer vision, natural language processing, recommendation systems, semantic search, ranking systems, embeddings, or related automated technologies.

"Content" means text, photographs, graphics, videos, software, metadata, product information, recommendations, search results, AI outputs, documentation, databases, and all other information made available through the Services.

"Daamia" means the operator of the Services together with its affiliates, successors, assigns, licensors, contractors, employees, and authorized representatives where applicable.

"Merchant" means any retailer, marketplace, manufacturer, distributor, seller, or business whose products appear within the Services.

"Platform" means all Daamia websites, applications, APIs, software, infrastructure, and related technologies.

"Search Results" means algorithmically generated listings, recommendations, rankings, product matches, image matches, AI-generated suggestions, and related outputs.

"Services" means all current and future products, websites, APIs, mobile applications, browser extensions, artificial intelligence systems, virtual try-on technologies, image search, recommendation engines, software, premium offerings, subscriptions, and related functionality operated by Daamia.

"User" means any individual or entity accessing or using the Services.

"User Content" means any photographs, images, text, feedback, reviews, comments, suggestions, uploads, or other material submitted by users through the Services.

"Virtual Try-On" means any technology that algorithmically generates simulated garment visualizations using uploaded photographs or other user-provided inputs.
